Bone grafts after a surgery on your back can be traumatic enough, but there are sometimes some pretty terrible effects of using the Infuse Bone Graft that will lead to even more problems down the line. Used to promote bone growth, it is used in spinal fusion procedures in skeletally mature patients who have degenerative disc disease. As many of these procedures are completed on patients who are already a bit older, there is of course increased risk about the kinds of things that can happen after the fact. Over the last few years, there have been a handful of side effects that have come up that kind pop up after one of these devices are used. They include

  • Allergic reaction to the synthetics
  • Tissue damage
  • Bone fractures

  • Loosening of the implant

  • Gastrointestinal issues
  • Bladder issues

    Claim Information

The Infuse Bone Graft, sold my Medtronic, was originally approved back in 2002 with the goal of infusing vertebrae in the lower spine after surgery to correct degenerative discs and associated diseases. It was used for years in order to treat severe back pain in place of using human bone particles as was the standard for decades before that. The device was created as a synthetic way of completing this process with “less risk of infection.” It featured a synthetic protein called recombinant human bone morphogenetic protein (rhBMP-2) in order to promote bone growth, and was initially hailed as a great advancement in the medical world.
Over the years, the FDA has fielded hundreds of complaints about the device, mainly due to the device being used for other types of back surgeries as well as the ones it was designed for. By 2008, a report came out from the FDA telling surgeons to only use the device for its intended use, after many patients complained about throat pain which were discovered to be as a result of nerve damage in the neck due to the device.
By 2012, it was discovered that Medtronic had paid research hundreds of millions in what they called “consulting fees’ ‘ to the Senate Finance committee who was investigating them at the time. This obvious conflict of interest remained a point of contention in many of the lawsuits, which still continue today.

How Do I Get Funding For a Lawsuit Like This?

The process of getting a loan for your Infuse Bone Graft case is pretty simple. First, it will be important for clients to have actually used the device in question and be affected by it in various ways, in addition to hiring a personal injury class action lawyer in order to represent them in their case against the medical supply giant. Some of the side effects that they must have been affected by include:

    • Spinal and neck inflammation
    • Breathing problems and constructions
    • Spinal nerve damage leading to severe neck and back pain
    • Extra surgery to remove bone overgrowth
    • Wrongful death

Once you are working with a class action lawyer for any of these reasons, it will be possible to file your claim under one of the following reasons:

    • Defective product
    • Medical malpractice by Medtronic and its subsidiaries
    • Medical negligence by Medtronic
    • Fraud by Medtronic
    • Faulty design and design negligence

    Who Needs A Lawsuit Loan?

While a pre-settlement loan or post-settlement loan sounds like an “easy way out” for some, it is important to consider that they are not good for every kind of client. The effects of your Infuse Bone Graft may have very well left you unable to work or create any kind of income. AS a result of the case, or perhaps before, you may have also not had much in the way of saying either. In those cases, these are the perfect kinds of clients who should be applying to lawsuit loans. For something, they might not even need that much money or for that long. Ultimately, it all comes down to how long you expect to be without your settlement. There are situations where you are still waiting for the case itself to be settled, which could result in a wait of a few months to even a few years. In the cases where the case has been settled but you are still waiting for the money to be paid out, you might be looking at a bit of a shorter wait but that is not guaranteed. Ultimately, you need to think about how much money you will need for at least a few months and going from there. On the flip side, if you are someone who has still been able to work or has plenty of savings, you might not be the best candidate for a lawsuit loan. It’s not always wise to put yourself into additional debt for something that might be pad out very shortly. Ultimately, it will come down to need and how long you are able to wait for what you’re looking for.

How Is Delta Settlement Funding Different Than a Bank?

Unlike many of the more traditional lending options like borrowing from a bank, using a service like Delta gives you peace of mind in a number of ways. Not only will you be able to get approved or not in just a matter of days, funded in less than a day and be able to enjoy a risk-free, low interest loan. In the event that you lose your case, you will not be expected to pay the loan back which is much different than many of the other options out there. With a low interest rate, you will not be stuck paying back high rates from your settlement money once you do receive it. In the end, Delta prides itself on ensuring that our clients not only end up getting the justice they deserve, but the dignity to wade through the troubling waters of that time period as well. It can be very tricky to deal with not being able to pay your bills in the interim, but being able to borrow at least a portion of what you are set to receive from a settlement will help greatly. When it comes to living expenses, utilities and other such bills, none of those things are going to wait for you to receive your settlement, so it’s always in your best interest to make sure that you have a way to pay them. With Delta, you will always have a reasonable way to stay on top of all of your expenses.
